1. Acceptance of Terms

By accessing and using MenuFlo (the "Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service. Your use of MenuFlo indicates your acknowledgment of these Terms and your agreement to be legally bound by them.

2. Description of Service

MenuFlo is a digital menu platform that helps independent restaurants establish and maintain an online presence. The Service allows restaurant owners to create, customize, and publish digital menus that are accessible to customers via a shareable link and QR code. MenuFlo is based in Ontario, Canada.

3. Free Plan and Pricing

What is "Free Forever"? When we say MenuFlo is "free forever" with "No Fees, Ever," we are referring specifically to core menu hosting — the ability to publish and maintain a publicly accessible digital menu for the lifetime of your account at no cost.

Free Plan Includes:

  • AI-powered menu creation tools
  • Custom branding (colors, fonts, and styling)
  • Mobile-optimized public menu page hosted at [slug].menuflo.com
  • QR code generation and management
  • Shareable menu link
  • Basic activity insights and analytics

Paid Plans: MenuFlo offers optional paid subscription plans (such as the Pro plan at $49.99/month) that unlock additional features including but not limited to: online ordering capabilities, kitchen intelligence and order management, custom domain support, advanced analytics, and priority support. Choosing a paid plan is entirely optional, and the core menu hosting service will remain free.

Modifications to Free Plan Features: MenuFlo reserves the right to modify, add, or remove specific features included in the Free Plan at any time. However, we will provide reasonable notice (at least 30 days) before making material changes that negatively impact your ability to maintain a publicly accessible digital menu. We are committed to keeping core menu hosting free for the lifetime of your account.

4. Account Registration

To use MenuFlo, you must register for an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account information and password. You agree to accept responsibility for all activities that occur under your account. You must notify MenuFlo immediately of any unauthorized use of your account.

5. User Content and Ownership

Your Content: You retain full ownership of all content you create, upload, or provide to MenuFlo, including menu items, descriptions, images, pricing, and branding elements ("Your Content"). You represent and warrant that you own or have the necessary rights to use all content you submit.

MenuFlo License: By uploading or providing content to MenuFlo, you grant MenuFlo a worldwide, non-exclusive, royalty-free license to display, distribute, and reproduce Your Content solely for the purpose of operating and providing the Service, including displaying your menu to end users.

No Unauthorized Use: You may not submit content that infringes on the intellectual property rights of third parties or violates any laws. MenuFlo may remove content that violates these terms at any time.

6. Acceptable Use

You agree not to use MenuFlo for any of the following purposes:

  • Transmitting obscene, threatening, abusive, or hateful content
  • Creating multiple accounts or using the Service in a fraudulent or deceptive manner
  • Attempting to gain unauthorized access to MenuFlo systems or other users' accounts
  • Uploading malware, viruses, or any code or software intended to disrupt or harm the Service
  • Scraping, crawling, or systematically downloading content from MenuFlo without authorization
  • Impersonating another person or entity
  • Using the Service to promote illegal activities or violate any applicable laws
  • Harassing, bullying, or targeting individuals or groups

7. Intellectual Property

MenuFlo Intellectual Property: MenuFlo owns all right, title, and interest in the Service, including the platform, software, design, features, and functionality. This includes but is not limited to trademarks, logos, source code, databases, documentation, and any improvements or modifications we make to the Service. No part of MenuFlo may be reproduced, distributed, or transmitted without our prior written consent.

Your Intellectual Property: As stated in Section 5, you retain full ownership of Your Content. MenuFlo does not claim ownership of your menu content, business information, or any intellectual property you create within the platform.

8. Third-Party Services

MenuFlo may integrate with or connect to third-party services, APIs, payment processors, and platforms. Your use of third-party services is subject to their own terms and conditions. MenuFlo is not responsible for the availability, functionality, or practices of third-party services. We recommend reviewing their privacy policies and terms before connecting your account.

9. Disclaimers

As-Is Service: MenuFlo is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that:

  • The Service will be uninterrupted or error-free
  • The Service will meet your specific requirements
  • Defects will be corrected
  • The Service is free from viruses or other harmful components

No Liability for User Content: MenuFlo is not responsible for any user-generated content, including menu information, images, or descriptions. We do not verify the accuracy, completeness, or legality of content uploaded by users.

10. Limitation of Liability

To the fullest extent permitted by law, MenuFlo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business, even if MenuFlo has been advised of the possibility of such damages. In no event shall MenuFlo's total liability exceed the amount you paid MenuFlo in the 12 months preceding the claim, or $100, whichever is greater.

11. Changes to Terms

MenuFlo may modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of MenuFlo after such notification constitutes your acceptance of the modified Terms. If you do not agree to the modifications, you must discontinue use of the Service.

12. Termination

MenuFlo may suspend or terminate your account and access to the Service at any time, with or without cause, upon notice. Upon termination, your right to use the Service ceases immediately. You may request deletion of your account and associated data through our contact page. MenuFlo will comply with applicable data protection laws regarding data deletion.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law principles. You agree that any legal action or proceeding relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.
